Subclass 407 Training Visa Major Changes 2026: New Offshore Rules from 12 November

The Australian Government has changed where applicants must be when they apply for, and receive, the Subclass 407 Training Visa. These Subclass 407 Training Visa major changes 2026 start on 12 November 2026 and apply to applications made on or after that date. They matter to people already in Australia on temporary visas, to overseas applicants, and to organisations that sponsor occupational training.
Two changes sit at the centre of the update:
- Applicants must generally be outside Australia when they lodge their 407 Training Visa application.
- Applicants must generally be outside Australia when the 407 Training Visa is granted.
Some exemptions may apply to specific categories of applicants, depending on the relevant provisions set out in the applicable immigration laws and ministerial instruments.
What Is the Subclass 407 Training Visa?
The Subclass 407 Training Visa is a temporary visa for structured, workplace based occupational training or professional development in Australia. It is designed for genuine skills development, not for filling workforce gaps or extending a stay in Australia.
The 407 Training Visa is generally granted for up to two years, depending on the approved training program. Applicants are normally sponsored by an approved Temporary Activities Sponsor and nominated for a specific occupational training program. Commonwealth agency sponsors are treated differently on nomination.
That background is enough to understand the update. The new rules change the location requirements, not the purpose of the visa.
What Are the Major Subclass 407 Training Visa Changes from 12 November 2026?
The 407 Training Visa new rules 2026 amend the Migration Regulations 1994 through a new set of amending regulations. They change two separate legal tests: the test for a valid application, and the test for grant. Each is explained below.
1. Applicants Must Be Outside Australia When Applying
Before 12 November 2026, applicants could generally lodge a 407 Training Visa application whether they were in or outside Australia. Applicants in Australia generally had to hold a substantive temporary visa, and some visa types were excluded.
From 12 November 2026, an application made while the applicant is physically in Australia will generally not be a valid application. This is a validity requirement, so it is tested at the time of lodgement.
The rule is subject to exceptions. The legislation allows classes of applicants to be specified by legislative instrument, and those applicants may apply in or outside Australia. Without a confirmed exemption, applicants should plan to lodge offshore.
This is separate from the earlier March 2026 change. Since 11 March 2026, applicants cannot lodge until the Temporary Activities Sponsor and the occupational training nomination have been approved, where a nomination is required.
Example: Priya holds a Student visa that expires in January. She has a training offer in Melbourne and wants to apply from within Australia. If she lodges on or after 12 November 2026 and no exemption covers her, her application will generally not be valid. She would need to plan to lodge from overseas.
2. Applicants Must Be Outside Australia When the Visa Is Granted
The second change is about grants. Previously, an applicant could generally be in or outside Australia when the 407 Training Visa was granted, but not in immigration clearance. Immigration clearance is the border process a person goes through when arriving in Australia.
From 12 November 2026, applicants must generally be outside Australia at the time of grant. The exception works differently to the application rule. As reported, an applicant can be in Australia at grant only if they were in an exempt class when they applied.
This means an offshore application does not finish the job. Location also matters on the day the decision is made. The legislation, as we understand it, tests location at the time of application and the time of grant. We have not seen anything requiring continuous absence from Australia in between, but that point must be confirmed against the legislation.
Example: Daniel lodges his application from Nepal. While waiting, he travels to Australia on another valid visa for a family event. If the 407 Training Visa is granted while he is in Australia, he may not satisfy the grant requirement. Travelling during processing carries real risk, so advice should come first.
Are There Any Exceptions to the New Subclass 407 Training Visa Offshore Requirements?
Yes, the framework allows for exceptions, but exceptions are not automatic. The regulations allow the Minister to specify classes of applicants by legislative instrument. For applicants in a specified class:
- The application can be made in or outside Australia.
- The grant can happen in or outside Australia.
- The applicant must not be in immigration clearance at the relevant time.
The application and grant rules can be dealt with separately, so a class may be exempt for one and not the other. Everything depends on the wording of the ministerial instrument.
Please note what this article does not say. We have not confirmed any instrument naming a class of exempt applicants. Do not assume that students, graduates, workers, particular occupations or any group of temporary visa holders qualify. Examples in explanatory material are not confirmed exemptions. Check the Federal Register of Legislation for the current instruments before relying on any exception.
Subclass 407 Training Visa: Before vs After 12 November 2026
| Requirement | Before 12 November 2026 | From 12 November 2026 |
| Application location | Applicants could generally apply in or outside Australia, subject to the other requirements. | Applicants must generally be outside Australia when applying. |
| Visa grant location | Applicants could generally be in or outside Australia, but not in immigration clearance. | Applicants must generally be outside Australia at grant, unless they were in an exempt class when they applied. |
| Onshore application | Possible for applicants who met the requirements, including holding a substantive temporary visa. Not every applicant was eligible. Since 11 March 2026, approved sponsorship and nomination were also needed before lodging. | Generally not permitted unless the applicant is in a class specified by legislative instrument. |
| Exemptions | No location exemption mechanism was needed, because applicants could generally apply in or outside Australia. | Ministerial instruments may specify exempt classes. Exempt applicants must not be in immigration clearance at the relevant time. |
What Happens to Subclass 407 Training Visa Applications Lodged Before 12 November 2026?
The amendments apply to applications made on or after 12 November 2026. They are not retrospective. A valid application lodged before that date is not subject to the new offshore requirements, which is consistent with how the Federal Register alerts describe commencement. Confirm this against the transitional provision in the final regulations.
Pending applications continue to be assessed against the other criteria that apply to them. That includes sponsorship, nomination, genuine training purpose, health and character requirements.
Do not confuse the November changes with the earlier March 2026 changes:
- 11 March 2026: Under the Migration Amendment (Training Visas-Sponsorship Requirements) Regulations 2026, a valid application requires an approved Temporary Activities Sponsor and, where the sponsor is not a Commonwealth agency, an approved nomination before lodgement.
- 12 November 2026: Applicants must generally be outside Australia when applying and when granted.
These changes work together. An application lodged on or after 12 November 2026 must satisfy both sets of rules where they apply. Readers can compare the explanatory statement for the March regulations to understand how sponsorship and nomination approval fits in.
How Will the New Subclass 407 Training Visa Rules Affect Applicants Currently in Australia?
The biggest impact falls on people who planned to move to a 407 Training Visa while staying in Australia. Plan for an offshore application unless a confirmed exemption covers you.
- Student visa holders (Subclass 500): Holders finishing a course should not assume they can move onshore to a 407 Training Visa. Our Student visa services can help you review your options before your current visa ends.
- Temporary Graduate visa holders (Subclass 485): The same planning point applies. See our guidance on the Temporary Graduate visa for how your remaining visa time affects timing.
- Other temporary visa holders: Workers and visitors in Australia should also assume offshore lodgement and offshore grant unless an exemption is confirmed.
- Applicants planning a transition: Plan departure dates, evidence and sponsor approvals early, because the timing now matters more.
Sponsors should also adjust. Employers using the Short Term Work and Training Visa pathway should tell trainees early that an offshore application is now the expected route.
Will Applicants Receive a Bridging Visa?
Not automatically. A bridging visa generally supports a person who is in Australia and has a valid application that allows them to remain lawfully while it is decided. These are the situations to separate:
- A valid onshore application: This may support a bridging visa in some circumstances. From 12 November 2026, onshore lodgement will generally not be valid, unless an exemption applies.
- An offshore 407 Training Visa application: An offshore application does not give permission to stay in or travel to Australia. A bridging visa is designed for people in Australia.
- Holding another substantive visa: Your current visa continues to govern your right to stay until it expires or is cancelled. An offshore 407 Training Visa application does not extend it.
Bridging visa eligibility depends on individual circumstances, so confirm yours with a migration professional before you act.
What Happens If an Applicant Lodges an Invalid 407 Training Visa Application?
An invalid application is not the same as a refused application. If the validity requirements are not met, the law generally treats the application as not having been made. No decision on its merits follows, so there is no refusal to review on the merits.
A refusal is different. A refusal means a valid application was assessed and the criteria were not met. Review rights, where they exist, depend on the circumstances, including where the applicant was when they applied. A challenge to an invalidity decision is a different legal question from merits review of a refusal. Our team handles visa refusal and cancellation matters and Administrative Review Tribunal matters.
An invalid application does not automatically mean unlawful status or visa cancellation. Your status depends on the visa you still hold. However, relying on an invalid application to stay in Australia can create serious problems, so get advice before lodging.
What Should Subclass 407 Training Visa Applicants and Sponsors Do Before Applying?
Follow these steps in order:
- Check your current visa. Confirm its expiry date and conditions, because they affect departure timing.
- Confirm Temporary Activities Sponsor approval. The sponsor must be approved before you can lodge.
- Confirm nomination approval. Where required, the occupational training nomination must be approved before lodgement.
- Prepare supporting documents before departure. Gather identity, qualification, training program and health insurance documents.
- Understand the offshore rules. Know the requirement for the application and the separate requirement for grant.
- Plan travel carefully. Avoid returning to Australia in a way that could put you inside Australia at grant.
- Monitor your ImmiAccount. Check regularly for requests, decisions and correspondence.
Employers should review their own obligations through our employer sponsored visa services.
Frequently Asked Questions
1. Can I Apply for a Subclass 407 Training Visa While in Australia After 12 November 2026?
Generally, no. For applications lodged on or after 12 November 2026, an application made while the applicant is in Australia will generally not be valid unless they belong to a class of applicants specified by a legislative instrument. At present, no such specified class has been confirmed. Applicants should check the latest immigration requirements before lodging their application.
2. Do I Need to Remain Outside Australia Until My Subclass 407 Training Visa Is Granted?
Generally, applicants must be outside Australia when their Subclass 407 Training Visa is granted. The requirements consider the applicant’s location at the time of application and at the time of visa grant. However, it is not clear that applicants must remain continuously outside Australia throughout processing. Being in Australia when the visa decision is made may create a risk of not meeting the grant requirements. Seek professional immigration advice before making travel arrangements.
3. Can I Travel to Australia While My Subclass 407 Training Visa Is Being Processed?
It may be possible to travel to Australia while your Subclass 407 application is being processed if you hold another valid visa. However, this can create complications if you are in Australia when the Subclass 407 visa decision is made, as you may not satisfy the offshore visa grant requirement. Applicants should seek professional advice about their individual circumstances before booking travel.
4. Are There Any Exemptions to the Offshore Requirements?
The legislative framework allows certain classes of applicants to be specified through a legislative instrument as exceptions to the offshore requirements. However, no applicable specified class has been confirmed at this stage. Applicants relying on an exemption must also satisfy the relevant conditions, including not being in immigration clearance at the relevant time.
5. Will Pending Subclass 407 Training Visa Applications Be Affected?
The new offshore requirements apply to Subclass 407 Training Visa applications lodged on or after 12 November 2026. Applications lodged before this date are not subject to these new requirements. However, applicants must still satisfy all other applicable sponsorship, nomination, eligibility and visa grant criteria.
6. Do I Need Approved Sponsorship and Nomination Before Applying?
Yes. For Subclass 407 Training Visa applications lodged on or after 11 March 2026, applicants generally need an approved Temporary Activities Sponsor and, where the sponsor is not a Commonwealth agency, an approved nomination before applying. Both sponsorship and nomination requirements must be satisfied in accordance with the applicable immigration regulations.
