Subdivision

In Victoria, subdivisions are a process of dividing a parcel of land into two or more smaller lots. This can be done for residential, commercial, or rural purposes. The process is governed by the Planning and Environment Act 1987 and managed by local councils. Each council may have different requirements for the approval.

Types of Subdivision

The main types of subdivision are listed below:

  • Residential subdivision is dividing land for housing development. This can range from creating just one extra lot like dual occupancy to large-scale subdivisions with many lots.

Licensed Surveyor

A licensed surveyor plays a critical role in the subdivision process, preparing plans and ensuring compliance with regulations. The surveyor will also submit the final subdivision plan for approval.

Once the planning permit is granted, the surveyor will prepare a Plan of Subdivision which shows the exact boundaries of the newly created lots. The surveyor will submit this plan to the council for certification.

Council Certification

The council will issue a Statement of Compliance (SOC) once all permit conditions have been met like infrastructure works. This compliance statement is required before the subdivision can be registered with the titles office.

Title Registration

After the SOC is obtained, the certified plan of subdivision is lodged with Land Victoria. Once the subdivision is registered, separate titles for each new lot are issued, and the land can be sold, leased or developed.
