The OMARA is a section within the Department of Home Affairs. It is based in New South Wales and report to the Department’s National Office in Canberra. The OMARA is led by a Senior Director who reports to the Group Manager, Immigration Operations.
The OMARA role is to protect consumers of migration advice services by only registering those people who meet our qualification and character standards. It investigates complaints about registered migration agents, this also helps to protect consumers.
The OMARA registers and oversees more than 4500 registered migration agents who give immigration assistance and as part of role, it does the following:
- help people who need immigration assistance understand their rights
- make sure registered migration agents understand their obligations
- keep a Register of registered migration agents
- check that registered migration agents maintain the knowledge they need to give clients accurate advice
- handle complaints about registered migration agents
- discipline registered migration agents when they don’t meet our Code of Conduct
The OMARA must also investigate complaints about registered migration agents. If it finds an agent has breached the agents’ Code of Conduct (the code), it may discipline them. It can do 1 of the following:
- caution them
- suspend or cancel their registration
- bar them from re-registering for a period of up to 5 years
